  Dying without a Will I had a call today from a client who unfortunately lost his mother to COVID-19 recently. The problem is he can’t find a  Will  and is pretty sure she never made one. I gave him the address of the National Will Archive but assuming there is no Will she has died INTESTATE. Dying Intestate means dying without a  Will  and can cause all sorts of problems, pain and extra hassle. New law for business owners and Directors - Lasting Power of Attorney

  The  Mental Health (Discrimination) Act 2013  takes out the option to remove a company Director because of mental health problems. This effective makes mental health problems a protected characteristic under the S4 Equality Act 2004 so that the same rules apply for partnerships or even sole traders. 1 in 6 of us under 65 will take time off for mental health problems during our working lifetime. The term mental health covers a wide range of illnesses from long-term dementia to taking time off for stress-related illness and everything in between. Power of Attorney – why are they important?

Important of  Power Attorney  A Power of Attorney nominates someone to act on your behalf should you lose mental capacity, as defined by the Mental Health Act 2005. Mental incapacity could be dementia or other mental health issues brought on by illness or even an accident. Importantly they are put in place BEFORE you lose capacity. Only if you are unable to make decisions for yourself does the Attorney(s) you chose to act on your behalf. Typically the Attorney is either a spouse or child. So why are they important to get set up now? There are a number of reasons I advise all my clients to have Lasting Power of Attorney (LPA) in place, not least peace of mind, but importantly because the alternative to an LPA is much more expensive and time-consuming . If you no longer have the capacity to make an LPA your spouse/ children have to apply to the Court of Protection for a Deputyship Order .
